All information on this website may include inaccuracies or errors and we do not guarantee the accuracy of, and disclaim all liability for any errors or other inaccuracies relating such information that appears on our website.
We reserve the right to correct any information and make changes to them from time to time.
We will not be liable for the acts, errors, omissions, representations, warranties, breaches or negligence of any such Suppliers or for any personal injuries, death, property damage, or other damages or expenses resulting therefrom.
We have no liability and will not make any refunds in the event of any delay, cancellation, overbooking, strike, force majeure, or other causes beyond our control and we have no responsibility for any additional expense, omissions, delays, re-routing or acts of any government or authority. In no event shall we be held liable for any direct, indirect, punitive, incidental, special or consequential damages arising out of, or in any way connected with, your use of this website or our services.
If we are found to be liable for any loss, damage despite the above limitation then our liability in no event will exceed (a) the service fee you have paid to us with regards to your travel arrangements, (b) RM250.00.
Governing Law
This Agreement shall be governed by and construed in accordance with the laws of Malaysia.
Right To Make Change To The Agreement
All travel arrangements involving airline and other components are subject to supplemental price increases that may be imposed by the vendor and/or government after the customer has completed their purchase by paying the deposit. You hereby adhere to any such price increases and authorize your understanding that the customer will know of and then assume the same position. Suppliers and Vendors have their own contracts covering cancellation penalties and other terms and conditions, and the customer may be bound by those contracts regardless of whether they receive notice of their terms. By signing below, you are consenting to those terms and conditions.
Any contact with the customer be it a prospective customer or previous customer of Hayya Travel, will be limited to the extent of the instructions and advice from Hayya. Agents will not take any actions that is not warranted by Hayya Travel. Any action whether direct or indirect that does not coincide with Hayya Travel’s instruction and advice will be considered a breach of the terms and conditions of the Agent Service Agreement.
Copyright & Intellectual Property
- Legal Rights
Author, copyright owner and performer is given an exclusive right to control under the copyright law. Legal rights that are given to them includes the rights to enforce their copyrighted works in cases for infringement either by civil or criminal action. In term of criminal prosecution, it is conducted by the Enforcement Division of Ministry of Domestic Trade, Cooperative and Consumerism (MTDCC) or Royal Malaysian Police. - Economic Rights
Economic rights that are given to rightholders includes rights of reproduction, rights of communication to public, rights to perform, showing or playing to the public, rights of distribution and rights of commercial rental. This rights can be exercised during the period of protection governed under Copyright Act 1987. Economic rights allows the owner of rights to derive financial reward from the use of his works by the user or commercial purposes. Form of economic rights can be by way of assignment, licensing and testamentary disposition. - Moral Rights

This rights allows the author to claim the originality rights of his or her creation.
– Integrity Rights
This right authorizes the author to prevent any users from distortion, mutilation or other modifications of his or her works whereby the result of the modification will significantly alter the original work and adversely affect the author’s honor or reputation.
User Guidelines (Rules, Restrictions, Requirements)
By booking your arrangement with us or using our website, you are agreeing to be bound by the terms of this Agreement, and any additional terms and conditions of any Supplier that are applicable to your booking, travel arrangements or use of any website content. You agree on behalf of yourself and those you represent to comply with all such terms and conditions, including the payment of all amounts when due. You agree that any violation any such terms and conditions may result in (a) the cancellation of your reservation or purchase, (b) your forfeiture of any monies paid for your reservation or purchase, (c) you being denied access to applicable travel services, and (d) our right to debit your account for any costs we incur as a result of such violation.
It your responsibility to fulfill the passport, visa, and other immigration requirements applicable to your itinerary. You should confirm these with the relevant embassies and/or consulates. We do not accept any responsibility in the case of you being unable to travel due to not complying with any such requirements.
You are also required to carry all forms of relevant individual identification to verify your identity.
It is your responsibility to ensure that all of the details on your travel documents are correct and to bring to our attention any errors or discrepancies immediately. Your travel documents are valuable and should be safeguarded as if they were case. It is not always possible to replace travel documents in the case of loss, theft, damage etc.
Prior to booking international travel, we recommend that you review any Malaysian prohibitions, warnings and advisories applicable to your destinations. By offering travel to particular destinations, we do not represent that travel in such destination is safe or without risk.
You further agree that in connection with your activities, you will not permit the use of our services or website by anyone that resides or is staying in a country for which such use is prohibited under Malaysian regulations.
If you encounter any problems during your journey, please inform our office immediately. If you fail to timely contact us, we will not be permitted the opportunity to investigate your complaint and attempt to rectify any error while you are away, and this may affect your rights under this Agreement.
